Part One: “Open up with Oreo” Campaign Giveaway

Please read these terms and conditions carefully. The terms and conditions set out below apply to all participants submitting entries for the Oreo “Open up with Oreo” competition in 2016.
The Competition will be conducted by Mondelez South Africa Proprietary Limited, 18 Harrowdene Office Park, Kelvin Drive, Woodmead, Sandton, 2191, Tel: 011 253 4000 ("The Promoter").
Submission by entrants for entry into the Competition will serve as acceptance by the entrants of all the related terms and conditions.

1. All South Africans except employees of the Promoter, any of its Associated Companies, their merchandisers, advertising, promotional and PR agencies, staff and employees of all mediums used to promote this competition and all their immediate families are allowed to enter this promotion. Competition is only open to RSA residents.
2. No persons under the age of 18 will be considered eligible for this Promotion.
3. The competition main prize giveaways include three Trips to New York City per family or group of 4 (four) valued at two hundred thousand rand (R200 000.00) (“Main Prize”).
4. Winner’s must be 18 years of age or older, winner’s guests must be 18 years or older unless accompanied by the parent/legal guardian of guest.
5. There will be additional spot prizes of Oreo merchandise and product hampers to be won through various campaign activities, such as but not limited to Activations, Social Media, Print and On-line Media partnerships. Entry to win any of these spot prizes does not enter consumers into the Main Prize giveaway as described herein.
6. The competition runs from the 1st March 2016 to the 10th May 2016. No entries received after 5pm on the 10th May 2016 will be accepted.
7. Entry to the competition is through the campaign SMS line or on the campaign website (www.letwonderout.co.za).
8. Multiple entries will be permitted, subject to each entry being submitted separately and in accordance with entry requirements.
9. The Promoter will not be responsible for any non-delivery of entries.
10. Winners can only win once. Once a winner has been announced, their details will be removed from the competition draws.
11. To qualify as a winner, the entrant and his / her travel partners must have a valid South African Passport valid until April 2017 and with 6 open pages at the date of entry. In addition the entrant and travelers must have no criminal record, be in good health and physically fit to be able to travel. The entrant/winner will be required to undergo a Vetting process to confirm eligibility. The entrant/winner must supply the children’s Unabridged Birth Certificates and valid Visas before the 8th August 2016 .
12. Obtaining an Unabridged Birth Certificate to travel to the United States is the responsibility of the winner and the cost thereof is excluded from the prize.
13. The costs pertaining to the application for standard Visa entry documents for the United States of America will be included in the prize package and will be limited to each individual per family or group.
14. Prize to be redeemed and trip to be fulfilled at sponsor designated dates from 28 September to 2 October 2016.
15. The itinerary, travel and accommodation arrangements as described in the Prize Description is fixed and may not be altered.
16. Should the entrant not have the relevant requirements in place by the specified submission date in clause 10, he/she shall have no claim to the Main Prize.
17. Winners will be contacted via telephone or email on the information provided at the time of entry.
18. The Promoter shall not be liable if they are unable to contact the winners within 12 hours of being drawn for any reason whatsoever. The Promoter may in its sole discretion forfeit the prize and draw a new winner from the eligible entries.
19. The Promoter may also in its sole discretion forfeit the prize or draw a new winner from the eligible entries should any drawn entrant not be able to redeem the prize in accordance to the terms and conditions set out herein.
20. This prize cannot be sold or transferred to any persons other than the winners.
21. Prizes are not transferable and may not be exchanged for cash.
22. The judge’s decision is final and no correspondence will be entered into.
23. Winners must be able to travel on Sponsor designated dates on 28 September to 2 October 2016.

Competition Entry Mechanics:
24. Entry to the competition is through any of the following platforms: Campaign SMS line or website (www.letwonderout.co.za). To enter, customers are required to buy a box of Oreo biscuits (176g or 429g) and:
a. SMS the last five digits of the barcode to the campaign SMS line 40185
b. Visit the campaign website (www.letwonderout.co.za) and complete a submission form where they will be required to supply the last five digits of the barcode, their full name, contact number, email address and the province they reside in.
25. There will be 3 Main Prizes in total, each consisting of a trip to New York for a family or group of four.
26. Three sets of ten finalists each will be chosen by way of random draw. Finalists will be vetted according to entry requirements and only valid entries will go into the final round. Invalid entries will be disqualified. Finalists will be chosen by a random computer generated draw by the 6th June 2016.
27. One winner will be chosen from each of the three valid finalist lists, by random draw. Winners will be chosen by an independent auditor. Winners will be announced on the 8th June 2016 on the Oreo Facebook page and www.letwonderout.co.za. Winners will also be announced at intervals throughout the campaign on various media platforms.

Prize Description
28. Each prize consists of one five day / four night trip for four people to New York City.
29. Trip consists of:
I. roundtrip coach class air travel for four people (winner and three guests) from a major airport nearest the winner’s residence in South Africa to New York City on Sponsor designated dates on 28 September 2016 to 2 October 2016;
II. Connecting flights within South Africa to a major airport if required only
III. Five days / four nights hotel accommodations in one family room
IV. Roundtrip ground transportation between airport/hotel in New York City
V. A pre-arranged tour of New York City
VI. A pre-arranged hospitality event with Oreo
VII. Standard Visa application costs and assistance with the Visa application process
VIII. A gift bag and fifty thousand rand (R50 000.00) spending money for the winner to be shared within the group, which will cover meals and spending money which will be loaded onto an international debit travel card.
IX. Spending money is subject to exchange rates.
30. All transport to and from the airport is for the winners own expense.

General:
31. Should any dispute arise in relation to the interpretation of these competition rules, the Promoter’s decision shall be final and no correspondence shall be entered into.
32. Important Notice: All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotional competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the Prize.
33. The Promoters may refuse to award any prize to a participant if there is suspicion of any irregularities or fraudulent activities.
34. All entrants/winners/travellers will be require to fill out an indemnity form before departing on the New York City trip.
35. Neither Promoter nor its agents or distributors will have any liability in relation to this promotion.
36. If the Promoters are required by any legislation, the Minister of Trade and Industry, or the National Lotteries to alter any aspect of the competition or to terminate competition, as a result of changes in legislation, the Promoters will have the right to terminate this competition with immediate effect and without notice of such termination. In such event all participants hereby waive any rights which they may have against the Promoters and acknowledge that they will have no recourse or claim of any nature whatsoever against the Promoters, its agents, contractors and/or sponsors.
37. Notification of the winners’ status must be kept confidential by the winners until the Finalists are publicly revealed by the Promoter. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of The Promoter brands into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion as determined by Promoter in its sole discretion.
38. At the Promoter's request, winners will be required to participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they may consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. All promotional activity will become the sole property of the Promoter. However, the winner has the right to decline an invitation to participate in any promotional activity or to object to these images being used by written notification to the Promoter at 18 Harrowdene Office Park, Kelvin Drive Woodmead, Sandton, 2191, Attention: Legal Department.
39. The Promoter may collect, store and use (not share) personal information of participants for communication or statistical purposes.
40. The Promoter, will at its own discretion, be able to amend the rules to the competition at any time during the duration of the competition.
41. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
42. Winner's details will be posted onto the Oreo Facebook page.

Part Two: #OreoSelfie Online Giveaway
The terms and conditions below apply to the Online Competition: #OreoSelfie
This competition, together with its entry mechanism and prize, is different to the above “Open up with Oreo” campaign giveaway in Phase 1.
Competition conducted by Mondelez South Africa Proprietary Limited, 18 Harrowdene Office Park, Kelvin Drive, Woodmead, Sandton, 2191, Tel: 011 253 4000 ("The Promoter").

Submission by entrants for entry into the Competition will serve as acceptance by the participant of all the related terms and conditions.
1. All South Africans except employees of the Promoter, any of its Associated Companies, their merchandisers, advertising, promotional and PR agencies and all their immediate families are allowed to enter this promotion. Competition is only open to RSA residents.
2. No persons under the age of 18 will be considered eligible for this Promotion.
3. There will be 300 prizes in total. Each prize consists of a hamper made up of Oreo product and promotional gifts and is valued at R300.
4. The competition will run from the 1st March 2016 to the 10th May 2016. No entries received after 5pm on the 10th May 2016 will be accepted.
5. The #OreoSelfie online competition can only be entered on the website (www.letwonderout.co.za).
6. Multiple entries are permitted, but only if each entry is submitted separately, in line with entry requirements.
7. The Promoter will not be responsible for any entries that are not delivered through the #OreoSelfie game application.
8. Winners can only win once. In the event that the winner’s name is drawn more than once the winner will be limited to one prize only.
9. By ticking the “I agree to the Terms and Conditions” button, the consumer agrees to all terms and conditions stipulated in this section and grants the company conducting the competition, and their affiliated agencies, the right to access and share the consumer’s #OreoSelfie image along with their Twitter handle and the answer to the question. No other personal information will be shared. The two consumers who are matched by the application will have visibility of each other’s #OreoSelfie images, Twitter handles and answers, as will other Twitter users who see these posts.

Competition Entry Mechanics:
10. For entries to be valid, consumers must share their #OreoSelfie image on Twitter and allow the game to tag their Twitter handle together with another Oreo fan’s Twitter handle (whom the entrant may or may not know) in the social media post.
11. #OreoSelfie images that have been downloaded and shared on Facebook are not valid entries, as the aforementioned process must be followed.
12. Winners will be chosen through random selection, from the pool of valid Twitter posts. Winners will be announced weekly and their names will be posted on the www.letwonderout.co.za site.

General:
13. Winners will be contacted via telephone or email, as provided at the time of entry
14. The Promoter shall not be liable if they are unable to contact the winners within 12 hours of being drawn for any reason whatsoever. The Promoter may in its sole discretion forfeit the prize or draw a new winner from the eligible entries.

Part Three: #OreoSelfie Activation Terms of Use
This Terms of Use Agreement (“Agreement”) explains your rights and obligations in using the Wonderselfie Application (all activities thereon, constituting “the Services”). By submitting your photograph to the application, you agree to abide by these terms of use.
Unless the disclaimer of such warranties is prohibited by applicable law, you expressly agree that access to the service by any means is at your sole risk, and the service is provided “as is” and “as available,” and we do not make any warranties whatsoever with respect to the service, including without limitation, warranties, either express or implied, such as the warranties of non-infringement, merchantability and fitness for a particular purpose, or that the service will be uninterrupted, error free or provide adequate, complete or timely information or data.
You are fully responsible for how you use our Services. You agree to indemnify and hold harmless us and our directors, officers, employees, service providers, vendors, our operating partners and agents from and against any and all losses, liabilities, claims, damages or expenses (including attorneys’ fees and court costs and expenses) arising from or related to any use of the Services by you or that occurs because of you.
Mondelez South Africa (Pty) Ltd does not claim ownership of any Content that you create or post through the Service. Instead, you hereby grant to Mondelez South Africa (Pty) Ltd a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service, subject to the Service's Privacy Policy.
Although it is our intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment.
